The main objective of this review article is to outline some fundamental conceptual elements that encompass the topic “children are subjects of rights”. This is a document that is the result of a review of the state of the art on the subject mentioned. The exercise is based on the bibliographic review and identification of 50 sources in indexed journals located in databases such as: Scielo, Redalyc, Publindex, Scopus, Ebsco, Dialnet, Doaj and Latindex, which were subjected to a rigorous analysis and systematization that would allow the construction of a possible recent theoretical scaffolding. In this way, it is intended to make an approach to the reality of childhood, recognizing that this social group is at a disadvantage to carry out actions that allow them to claim their own rights. Often, adults, having different conceptions about childhood, are unaware of the importance of this group of human beings and their fundamental role in the social fabric. Therefore, they need adults to be their spokespersons and advocate for their needs. However, it is understood that as children grow older, their ability to become social actors in defense of their own rights also increases
