Importancia del reconocimiento del territorio “Katsa Su” del pueblo indígena Awá como víctima del conflicto armado

Abstract

La presente investigación tiene como objetivo destacar la importancia del reconocimiento del territorio “Katsa su” del pueblo indígena Awá como víctima del conflicto armado y cómo se asumió un aspecto jurídico tan relevante como es auto de acreditación SRVBIT - 079 del 12 de noviembre de 2019 de la Jurisdicción Especial para la Paz respecto al impacto del conflicto armado en el territorio, beneficiando a la población indígena al dejar explicita su vivencia y el impacto de la norma nacional en ellos, desde la protección étnica, de eliminar el concepto de desalojo y despojo. Fue importante iniciar por la conveniencia del mismo, ya que de tener acceso a la población se vivenció un fenómeno social, por esta parte de la comunidad. De acuerdo a esto, la investigación se plantea en diferentes apartes, en el primero se presenta el problema de investigación que da forma al estudio, la pregunta de investigación y los objetivos, que guiaron todo el proceso de investigación, en un segundo aparte, se da a conocer el estado del arte de la investigación y los aportes teóricos que permitieron acercarse a los resultados, a continuación la metodología que se basó en el paradigma cualitativo y desde la mirada crítico social de la investigación, igualmente, se presentan las técnicas en las que se apoyó la investigación para la recolección de información. Continuado con este orden se indican los resultados, que se organizan en los objetivos específicos, iniciando con la concepción de la población Awá acerca de territorio, continuando con los antecedentes legales y jurisdiccionales relacionados con el territorio como sujeto de derecho y en especial el territorio indígena como sujeto de derechos, dando a conocer el impacto del reconocimiento otorgado por la JEP a la comunidad.

This research aims to highlight the importance of the recognition of the "Katsa su" territory of the Awá indigenous people as victims of the armed conflict and how a legal aspect as relevant as the accreditation order SRVBIT - 079 of November 12, 2019 of the Special Jurisdiction for Peace regarding the impact of the armed conflict in the territory was assumed, benefiting the indigenous population by making explicit their experience and the impact of the national norm on them, from ethnic protection, to eliminate the concept of eviction and dispossession. It was important to start with its convenience, since having access to the population a social phenomenon was experienced by this part of the community. According to this, the research is presented in different sections, the first presents the research problem that shapes the study, the research question and the objectives, which guided the entire research process, in a second section, the state of the art of the research and the theoretical contributions that allowed to approach the results are presented, then the methodology that was based on the qualitative paradigm and from the critical social perspective of the research, likewise, the techniques on which the research was based for the collection of information are presented. Continuing with this order, the results are indicated, which are organized into specific objectives, starting with the Awá population's conception of territory, continuing with the legal and jurisdictional background related to the territory as a subject of law and especially the indigenous territory as a subject of rights, making known the impact of the recognition granted by the JEP to the community.
